Narsh asked:
My mother in law is from China and she’s been staying with us for 4 months now helping to care for my son who’s 11 months now. She wants to stay on a little longer just to make sure we can get along without her but her visa ends in 2 months. I went through the extension process myself in China but I don’ know the equivalent of the exit and entry administration here and googleing didn’t go so well. Who has control over her visa if she came in at NY and she’s been living in NJ? Thanks for the help.
Those visitors who wish to stay beyond the time indicated on their Form I-94 must contact the Department of Homeland Security’s Bureau of Citizenship and Immigration Services to request an application to extend status. The decision to grant or deny a request for extension of stay is made solely by the Bureau of Citizenship and Immigration Services.
For more information on how to extend your stay, the requirements, the forms needed and the procedures then refer to the website below.
The form which your mother-in-law requires is Form I-539 (Application to Extend/Change Nonimmigrant Status)
The Form I-539 can be downloaded on following website, please make sure you read everything carefully before submitting the form.
You would submit the form, fee and any supporting documents required to the USCIS Vermont Service Station, the address of which can be found on the website above.
