does the statement”the welfare of the people is the supreme law” applies to any kind of law?

because in a debate about taxing texting which is a form of communication,it was argued that the government should not legalize taxing texting since they must take observe first “the welfare of the people is the supreme law”
note:the setting is in Philippines, although im curious if it also aplplies to every law in every country including CHina..

  1. No, because then anyone could justify any action in the name of “the welfare of the people,” in defiance of the actual stated law.

    I think a better principle would be to ensure that the welfare of the people is the basis for actual laws. Not above them.
