We married in Dec 2005, and filed for her Green Card in February 2006 and had our interview in June 2006, when we were told the FBI hasn’t completed their background check yet and it could take several months to several years. I heard that Chinese Scientist are having to sue the Federal Government to get action and it seems to work. I was told by my senator’s office (Maria Cantwell’s Office) to wait six months before suing. They were the ones that told me that law suits seem to get some action in getting the background check done.
there is not other way, but CIS just implemented a policy that they will not expedite the process now just because they are being sued, good luck

Sue for what? Is there a statutory requirement that the check be completed in a set amount of time? The judge is going to tell you to wait your turn like everybody else.

I’m American as well, i married a Latina 6 years ago, i haven’t even seen her for 1 year now, the phone calls i make 4 times a day 7 days a week are all we have, and i have an approved I-130- document,for the spouse of a American citizen, i just this week drove 4 hours to a INS office to get no answers to my questions, and to top it off, they told me my approved I-130- document didn’t mean to much,but they are always informative about where i need to send the money for each document they say i need, we should all be clear minded enough to see this country no longer belongs to the citizens living within its boarders,and as for you and i, well they say if we want to move to another country to live with our wife’s, well that’s up to us, that’s the words the INS officer said to me on the phone, so you see what your up against is a wall, unless you can get her a job cleaning house for a rich snob is government, then getting a visa is easy, good luck buddy.

You can sue, but it really doesnt help. You are not alone, and it mostly affects Middle eastern man. Chineese scientist – its not common for them.
