I own a piece of papercutting art by a Chinese artist. I would like to utilize a scan of this artwork as part of a for-profit commercial bookcover. The book will be released in the US and EU. The Chinese papercutting artist is alive and their name is known. The papercutting is a limited edition, however it is probably not the only one in existence. I may be able to get in touch with the artist, but it may be difficult due to distance and language difficulties. What would be the best course of action in regards to securing the legal right to utilize the work?
First of all, there is no such thing as an “international copyright.” Each country will have its own copyright laws. So for each country’s copyright, different requirements may exist.
That said, getting permission does effort. You’re right that it may be difficult due to distance and language difficulties. But that’s the price of doing business internationally.
